Terms of Use

These Terms of Use ("Terms") are an agreement between you and 2BuyAndSell ("we," "us") for your use of 2buyandsell.com and the 2BuyAndSell service (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can use the Service

You must be at least 18 years old. If you use the Service for a business, you confirm that you're allowed to agree to these Terms for that business.

2. What 2BuyAndSell is, and isn't

2BuyAndSell is software. Its readiness scores, price ranges, loan program suggestions, home value ranges and net estimates are general estimates based only on the answers people enter.

2BuyAndSell is not a lender, mortgage broker, loan originator, real estate brokerage, appraiser or credit reporting agency. It does not pull credit, approve or deny loans, appraise property, or guarantee any price, rate or result. Nothing on the Service is legal, tax, financial or real estate advice. Anyone buying or selling a home should talk with a licensed lender, real estate professional and other advisors.

3. The founding list

• Joining the founding list is free. It is not a purchase and doesn't commit you or us to a contract.
• The founding offer is for the first 20 eligible San Antonio-area real estate professionals who confirm a paid account when we launch: the Pro plan at $29 per month for their first 12 months. After that, the regular price applies unless they cancel. We'll confirm the price with you before any charge.
• We may change features, plans or launch timing before launch, and we may close or limit the founding list at any time.

4. Paid accounts

• Plans are billed monthly or yearly, in advance, through our payment processor.
• You can cancel anytime. Your account stays active until the end of the period you paid for. We don't give refunds for partial months unless the law requires it.
• We'll give you at least 30 days' notice by email before a price change affects you.
• Each agent and each loan officer must pay for their own account. Nobody may pay for another person's account, or pay or accept anything of value for referrals, through the Service.

5. Your responsibilities as an agent or loan officer

If you use 2BuyAndSell for your business, you agree that:

• You hold every license your work requires, and the information on your page (name, brokerage, license number, contact details) is true and current.
• You'll follow the rules that apply to you, including Texas Real Estate Commission (TREC) rules (such as showing your broker's name and the Information About Brokerage Services and Consumer Protection Notice links), your broker's policies, and NMLS and lending rules if you're a loan officer.
• You'll follow the Fair Housing Act and all anti-discrimination laws. You won't use the Service to treat anyone differently because of race, color, religion, sex, disability, familial status, national origin, or any other protected class.
• You'll follow the Real Estate Settlement Procedures Act (RESPA). You won't use the Service to give or receive referral fees or kickbacks.
• You'll follow privacy and marketing laws when you contact people, including getting consent before texting or autodialing (TCPA), honoring opt-outs, and following email marketing rules (CAN-SPAM).
• You have the rights to every photo, logo and piece of content you upload.
• You're responsible for how you use and protect the leads you receive.

6. Marketing kit content

While your account is active, you may use the posts, videos and captions we provide to market your own business. Some photos come from Pexels and are used under the Pexels license: don't sell them as photos, and don't use photos of people in a way that suggests those people endorse you. Photos marked for ads have no people in them. Captions are starting points, so review them before posting to make sure they're accurate for you and follow the rules that apply to you.

7. Things you may not do

• Break the law or anyone's rights, or post false or misleading information.
• Upload viruses, scrape the Service, overload it, or try to get around its security.
• Copy, resell or rebuild the Service, or use our name or logo without permission.
• Use the Service to collect information about people without their knowledge.

We may suspend or close accounts that break these Terms.

8. Our content

The Service, including its design, text, software and the 2BuyAndSell name and logo, belongs to us or our licensors. These Terms don't give you any ownership of it. You keep ownership of the content you upload, and you let us use it only to run the Service for you.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be error-free or always available, or that any estimate will be accurate.

10. Limit of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deals or lost data. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.

11. Indemnity

If you use the Service for your business, you agree to defend and hold us harmless from claims that come from your content, your dealings with clients, or your breaking these Terms or the law.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Bexar County, Texas, and you and we agree to those courts.

13. Changes to these Terms

We may update these Terms. We'll post the new version here with a new date, and we'll email account holders about significant changes. Using the Service after a change means you accept the new Terms.
